How are Binary options regulated in Indonesia
Indonesia treats the retail binary options platforms covered by its regulatory warnings as illegal online gambling, not as licensed investment services. The official position goes beyond saying that these platforms lack registration. In its warning on binary options and illegal brokers, Indonesia’s investment task force described their price prediction activities as gambling and instructed promoters to stop advertising them.
For Indonesian residents, the question is therefore not just which broker offers better withdrawals or larger payouts. It is whether the product can lawfully be offered at all. This guide explains Indonesia’s position, the authorities involved, changes to financial supervision, and the practical steps available after a suspected fraud. Are binary options legal in Indonesia?
The Indonesian authorities have rejected the retail binary options model promoted through online trading apps. In a February 2, 2022 statement on illegal trading websites, the Commodity Futures Trading Regulatory Agency, known as Bappebti, described binary options as online gambling disguised as commodity futures trading. It stated that the binary options apps then circulating had no legal standing in Indonesia.
Calling this market “unregulated” can therefore give the wrong impression. It suggests an activity waiting for a licensing framework, rather than one that authorities have identified as prohibited gambling and targeted for enforcement. Readers should not interpret the absence of a binary options license category as permission to operate without one.
The product’s structure helps explain the distinction. A binary option pays according to whether a stated condition is satisfied at expiry. It does not give its holder the right to buy or sell the underlying asset, as the CFTC and SEC explanation of binary options describes. A currency chart on the screen does not mean the customer is buying currency.
Consider a hypothetical Rp100,000 stake on whether a quoted price rises over the next minute. A correct prediction might return the stake plus Rp80,000; an incorrect prediction might lose the entire stake. That illustrates a payout arrangement, not an exchange of the asset shown on the chart. Which authorities are responsible?
Several Indonesian authorities have relevant duties, but they do not perform the same job. A financial regulator’s licensing role differs from the government’s power to restrict website access, and both differ from a police investigation.
The division of financial supervision also changed on January 10, 2025. The joint announcement from Bappebti, OJK and Bank Indonesia transferred supervision of digital financial assets and certain financial derivatives away from Bappebti. Older explanations that place every currency, crypto and derivatives activity under Bappebti are no longer reliable.

For securities based derivatives, OJK subsequently confirmed on October 6, 2025 that the transfer included relevant orders routed to overseas futures exchanges. This matters when checking a genuine derivatives business: the correct regulator depends on the activity and underlying product, not simply the word “trading.”
These transfers should not be read as binary options legalization. They redistributed supervision of financial activities. As discussed below, Bappebti’s reporting continued to place binary options within its action against illegal entities during 2025.
How Indonesia enforces its position
Website blocking remains part of the enforcement response. Bappebti’s 2025 performance report records 60 entries in the binary options category of its table on blocked illegal entities. This provides more recent evidence of enforcement than the warnings that attracted attention in 2022. It also shows why those earlier warnings should not be treated as a short campaign that simply expired.
Blocking figures need careful interpretation. They are administrative enforcement records, not a count of convictions, individual victims or completed refunds. A blocked address and a recovered bank balance are very different outcomes. The report does not establish that each entry represents a separate business or that every affected customer recovered money.
Authorities have also acted against promotion. In the February 17, 2022 task force announcement, influencers and affiliates were told to stop promotion and trading training connected with binary options and illegal brokers, and to remove related social media material.
If you publish trading content, the practical lesson is straightforward: do not assume that calling a paid referral “education” settles its legal status. Before accepting an affiliate arrangement, obtain advice on the product, the operator and the proposed promotion. A disclaimer at the bottom of a video is not a substitute for that review.
Can users face criminal liability?
It would be misleading to say that only platform operators face potential legal exposure. Indonesia’s current Criminal Code includes offenses relating to participation as well as the provision of gambling opportunities. The Ministry of Law confirms that the new criminal law framework took effect on January 2, 2026.
Under Articles 426 and 427 of Law No. 1 of 2023, the law distinguishes between providing unauthorized gambling opportunities and using them. Article 426 covers several forms of gambling business activity, including offering opportunities without permission, and provides for imprisonment of up to nine years or a fine. Article 427 addresses using an unauthorized gambling opportunity and provides for imprisonment of up to three years or a fine.
Those are statutory maximum penalties, not an automatic sentence for every account holder. Applying an offense requires an assessment of the conduct and evidence. Equally, the fact that someone lost money does not by itself settle whether their legal position is that of a deceived customer, a participant, a promoter or another party.
Anyone involved in a dispute should ask an Indonesian lawyer to assess what happened, when it happened, what representations were made, and whether any recruitment or promotional activity took place. Older transactions require attention to the rules and transitional provisions relevant to their dates. General information about the Criminal Code cannot replace advice on an individual case.
Does an overseas license make a platform lawful?
An overseas regulatory claim does not answer the Indonesian authorization question. The domestic warning concerns the binary options activity itself, not just whether the operator has a company registration somewhere else. The task force’s gambling classification should therefore be the starting point, rather than a badge displayed on a broker’s website.
Separate three questions when reviewing a claim: which legal entity holds the document, what activity it covers, and where that activity may be offered. Ask for the actual regulator and authorization record. Do not accept an image of a certificate as the end of the inquiry.
Consider a hypothetical group that has one authorized financial company and a separate offshore website. A promoter might show the first company’s paperwork while asking customers to open accounts with the second. Your review should follow the entity named in the customer agreement, not the best known brand in the group.
Nor should an accessible website, Indonesian language support or a successful rupiah deposit be treated as evidence of approval. The same applies to access through a VPN. These features concern access and payment, not whether an Indonesian authority has authorized the service.
How to check a claimed Indonesian authorization
For businesses claiming OJK supervision, use the OJK Financial Institutions Directory. It provides information on financial businesses and professionals that are licensed, registered or supervised by OJK, together with official communication channels. For commodity futures brokerage claims, Bappebti provides a legal status checking service with access to its futures broker records.
Compare the legal company name, authorization number, website and contact details. Then ask whether the permission covers the product being offered. Do not stop after finding a vaguely similar company name. If the details do not match, contact the authority through its own published channel before sending money.
A useful written question is: “Does this entity have permission to offer this exact contract to retail customers in Indonesia?” Attach the contract description and website address. That is more useful than asking whether a brand is “safe,” which can mean anything from technical security to withdrawal speed.
Use these checks to investigate an authorization claim, not to shop for a supposed loophole in the binary options restrictions. A professional website can make verification feel unnecessary, it should do the opposite. The more confidently a business claims official approval, the easier it should be to check its paperwork independently.
What protection is available after a deposit?
Do not assume that an unauthorized binary options account receives the same dispute handling as an account with an authorized futures business. In its binary options warning, Bappebti expressly stated that it could not mediate disputes between customers and the providers concerned. That warning does not mean suspected fraud should go unreported; it means routine regulatory mediation must not be assumed.
Where deception, unauthorized transfers or a fraudulent payment request is suspected, stop sending further funds and contact the bank or payment provider used for the transfer. Ask what protective or dispute steps remain available for that transaction.
The official Indonesia Anti-Scam Centre reporting portal explains the financial reporting process and advises victims to make a separate police report. Prepare the following before submitting:
- Transaction records: transfer receipts, dates, amounts, originating accounts and recipient account details.
- A clear chronology: how contact began, what was promised, when payments were made and what happened afterward.
- Supporting evidence: advertisements, messages, account statements, withdrawal requests and the relevant website addresses.
- Identification and contact details: the information required by the reporting portal, submitted through the official service rather than an unsolicited message.
IASC coordinates with financial institutions to try to suspend transactions and trace remaining funds. Its financial response does not replace a police investigation, and it expressly states that reporting does not guarantee recovery. Report promptly, but do not budget on the assumption that the money will return.
Be wary of the next person offering to recover it. OJK has issued a warning about fake IASC websites and impersonators. Verify any claimed official contact independently. Do not hand over banking passwords, one time codes or additional payments because someone promises a faster refund.
Keep binary options separate from lawful financial products
Indonesia’s rejection of retail binary options should not be stretched into a claim that every option or financial derivative is prohibited. OJK’s regulation on derivatives with securities as underlying assets establishes rules for products, market participants and infrastructure. The legal assessment depends on the contract and its authorization, not just a familiar asset name.
If your interest is currency exposure, compare the actual contracts rather than treating every currency chart as forex trading. Ask who holds your funds, how prices and settlement work, which authority supervises the activity, and what complaint process applies.
For Indonesian residents, the practical decision is to establish legality before evaluating returns. Do not begin with a deposit and hope to resolve the regulatory questions later. If money has already been sent, preserve the evidence, use official reporting channels and obtain legal advice where your position is uncertain.
